These Terms of Service and Software License (the “Terms”) govern your access to and use of the LastCUE website, desktop application, account, subscriptions, Repair Credits, support, and related features (collectively, the “Service”).
The Service is operated by SHUAI JINGYAN, an independent developer based in China, under the “LastCUE Lab” brand (“LastCUE,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing the website, creating an account, purchasing, downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Purchases completed through Creem or another checkout provider are also subject to the buyer terms, refund policy, and transaction terms shown at checkout. These Terms primarily govern your use of the LastCUE software and Service.
Important Notices
- Monthly and annual Pro subscriptions renew automatically until canceled. Repair Credits do not renew automatically unless checkout clearly says otherwise.
- Repair features generate candidate outputs and do not guarantee recovery of any particular data.
- Repair Credits are delivered digital repair services. Once you confirm a repair task, Substantive Processing is completed, and a repair output or completion report is provided, the credit is normally consumed and not refundable except as required by law, applicable Creem Buyer Terms or procedures, or the LastCUE Refund Policy.
- The default repair workflow does not overwrite the source. If you expressly select write-back, direct overwrite, USB output, or a similar function, LastCUE will write to the destination you choose. Always keep a complete backup on a separate device and test the result before performance use.
1. Eligibility and Acceptable Use
You must have the legal capacity required to enter into these Terms where you live. You must be at least 16 years old, or the minimum age required in your country or region to use online services and enter into these Terms, whichever is higher. If you are below that age or otherwise lack legal capacity, you may use the Service only with valid consent and supervision from a parent or legal guardian.
LastCUE is not directed to children, and you must not submit a child's personal data, USB library, diagnostic package, or support file unless you have the legal authority to do so.
If you use the Service for a company, studio, venue, paid DJ work, customer USB repair, professional library maintenance, or any other commercial purpose, you are a Business or Professional User and confirm that you have authority to accept these Terms for that use.
You may use LastCUE only with data and storage media that you own or are legally authorized to access, back up, inspect, convert, or repair. You may not use the Service to bypass licensing, subscriptions, encryption, digital rights management, authentication, or access controls, or for unauthorized access, infringement, fraud, system interference, or any unlawful purpose.
2. The Service and Supported Formats
LastCUE is a local-first tool for backing up and inspecting supported
legacy rekordbox™ USB libraries and, where available, reviewing changes
and generating candidate repairs. It is primarily designed for USB
export structures containing PIONEER/rekordbox/export.pdb
and certain supported related files, including some files under
PIONEER/USBANLZ.
LastCUE currently does not support OneLibrary or Device Library Plus
formats, including exportLibrary.db, and does not promise
to read, decrypt, convert, or repair those formats. Available features,
system requirements, supported formats, and plan benefits are described
on the relevant product page, in the application, or in current
documentation.
Backups, reports, and repair outputs created by LastCUE are not complete disk images and may not include every audio file, analysis file, or other item on the source media. You must verify all outputs before writing them to production media or using them for a performance.
LastCUE does not modify the rekordbox application itself and is not intended to circumvent any third-party license, subscription, encryption, or access-control system.
Format Conversion and Audio Writes
Some utilities, including FLAC-to-MP3 or high-bitrate WAV-to-MP3
conversion, may create new audio files on the destination you choose and
may update related library, analysis, PDB, ANLZ, Contents,
or other files only when you expressly run an apply, write-back, direct
overwrite, or similar action.
Format conversion and write-back features should be used only on media that you own or are authorized to modify and only after creating an independent backup. Preservation of Cue points, Loops, analysis references, metadata, playlist position, and player compatibility is best-effort and depends on the source files, source database, rekordbox version, DJ hardware, and selected options.
3. Accounts and Software License
Some features require an account or paid entitlement. You must provide accurate information, protect your credentials, and notify us promptly if you become aware of unauthorized access. Unless your plan clearly permits team use, an account is for the registered user only.
While you comply with these Terms and hold the required entitlement, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to install and use LastCUE for personal use or for the internal business purposes of your organization.
Except where applicable law or an included open-source license expressly permits otherwise, you may not sell, rent, resell, publicly distribute, sublicense, or commercially provide LastCUE to another person; bypass account, license, subscription, Repair Credit, feature, or security controls; reverse engineer, decompile, disassemble, or attempt to extract source code; interfere with the Service or introduce malicious code; or remove proprietary notices.
4. Purchases, Subscriptions, and Creem
Where Creem is identified as the seller or Merchant of Record at checkout, Creem acts as the contractual seller for the transaction and handles payment collection, applicable transaction taxes, payment confirmations and invoices, recurring billing, and related transaction support. The price, currency, taxes, billing period, trial terms, renewal amount, and payment method are those shown at checkout and in the transaction confirmation.
Monthly and annual Pro plans are billed in advance and automatically renew for the selected billing period until canceled. Repair Credits are one-time purchases and do not renew unless checkout clearly states otherwise.
If a US$99 Lifetime Pro option is offered, it is a one-time paid entitlement for the operational lifetime of the LastCUE product or service as described at purchase, not for the lifetime of any person, device, operating system, rekordbox version, or third-party platform. Lifetime Pro does not renew and is non-refundable after purchase except where required by mandatory law, applicable Creem Buyer Terms or procedures, or failed delivery that cannot be reasonably corrected.
You may cancel a subscription through the link in your Creem purchase email or the Creem Customer Portal, an available LastCUE account page, or the applicable support channel. Cancellation normally takes effect at the end of the current paid billing period. Deleting your LastCUE account does not necessarily cancel a Creem-managed subscription.
Subscription prices may change for future billing periods. Any increase will normally apply from a later renewal and will be communicated as required by applicable law, giving you an opportunity to cancel before it takes effect.
If a payment fails, is reversed or refunded, is subject to a chargeback, or is reasonably identified as fraudulent or abusive, the corresponding subscription, license, or Repair Credits may be suspended, adjusted, or revoked, subject to applicable law.
5. Repair Credits
One Repair Credit permits one controlled repair attempt on one selected supported library. LastCUE may reserve the credit when a task starts. Substantive Processing begins after the selected library passes the initial format check and enters analysis or rebuilding.
By confirming a Repair Credit task, you request immediate performance of a digital repair service. To the extent permitted by law, once Substantive Processing is completed and LastCUE provides a repair output or completion report, the credit is delivered and consumed. A successful repair task is not refundable merely because the recovered result is partial, different from what you hoped for, or unsuitable for a later performance workflow. The exceptions are described in the Refund Policy and include LastCUE system error, duplicate charge, failed delivery, mandatory consumer rights, and applicable Creem Buyer Terms or procedures.
Unless the application or checkout clearly states a different rule:
- if the format is identified as unsupported before Substantive Processing begins, the credit is released;
- if a LastCUE system error prevents completion and no repair output or completion report is provided, the credit is restored;
- if Substantive Processing is completed and a repair output or completion report is provided, the credit is consumed, even if only part of the data is recovered or no recoverable content is found; and
- if a task is interrupted because you cancel it, select the wrong file, disconnect a device, lose power, run out of storage, or change the source files, the credit is released if Substantive Processing has not begun and consumed if it has begun. Task records may be used to confirm the processing stage.
Repair Credits are tied to the purchasing account. They may not be sold, transferred, redeemed for cash, or used outside LastCUE. Any expiry period is the period clearly shown at purchase. If no expiry is disclosed at purchase, a credit does not expire merely because time passes.
Repair results depend on the extent of corruption, readable records, related files, device condition, file paths, and third-party compatibility. A Repair Credit does not guarantee recovery of any particular track, playlist, Cue, Loop, waveform, analysis file, or audio file.
Cancellation and refund rules are explained in the LastCUE Refund Policy.
6. Local Processing and Privacy
In the default local workflow, LastCUE processes source media and output files on your device. Unless you deliberately use an upload, cloud, remote-support, or similar feature, LastCUE does not upload the complete contents of your USB drive or your audio files to our servers.
Account registration, sign-in, purchases, subscriptions, device licensing, Repair Credits, diagnostics, support requests, and files that you choose to submit may involve online processing. Our handling of personal information is described in the LastCUE Privacy Policy.
You retain your rights in your data. You give us only the limited permission reasonably necessary to provide the Service at your direction, investigate problems, maintain security, respond to support requests, and comply with law.
Before sending files to support, remove unnecessary personal information, audio files, credentials, local paths, and third-party confidential information whenever reasonably possible.
7. USB Safety and Your Responsibilities
LastCUE may interact with valuable or irreplaceable data.
The default candidate-repair workflow reads from the source and writes to a separate local folder. File conversion, write-back, direct overwrite, restore-to-media, or choosing a USB drive as an output destination may create, replace, or overwrite files described in the application and will use storage space on the selected destination.
Before any repair or write operation, you should create a complete disk image or complete file-level copy on a separate reliable device and confirm it is readable; verify the destination, path, file system, and available space; maintain stable power and do not disconnect the device; never use your only performance USB as the first test target; and test the result on separate media in the rekordbox version and DJ hardware you intend to use.
A backup stored on the same damaged USB drive is not an independent backup. LastCUE cannot determine whether a selected device is your only copy, a live-performance drive, or the intended destination. You are responsible for the final destination selection and for deciding whether and how to use an output.
8. Availability, Updates, and Third Parties
We use reasonable efforts to maintain the Service, but do not guarantee uninterrupted or error-free operation, or compatibility with every operating system, database version, USB device, file system, rekordbox release, or DJ hardware product.
Third-party software, hardware, formats, interfaces, services, or policies may change without our control and may cause a LastCUE feature or compatibility path to change or stop working. Links to third-party websites and services are provided for convenience; their own terms and privacy policies apply.
We may release security updates, bug fixes, compatibility updates, and feature changes. Beta, experimental, preview, or candidate features may be incomplete, unstable, changed, or withdrawn and should not be the sole basis for a backup or live-performance workflow.
If we materially reduce or permanently discontinue a paid Service, we will provide reasonable notice where practicable and handle remaining access, replacement benefits, refunds, or another appropriate remedy in accordance with applicable law and the purchase commitment. Unless a paid plan expressly states a service level, support does not guarantee a particular response or resolution time. Support is not an emergency data recovery service, performance-day guarantee, forensic recovery service, hardware repair service, or replacement for official rekordbox, AlphaTheta, Pioneer DJ, operating-system, storage-device, or payment provider support.
We are not responsible for delay or failure caused by events beyond our reasonable control, except where applicable law requires otherwise.
9. Intellectual Property and Trademarks
Except for your data and third-party materials, the LastCUE software, website, interface, documentation, branding, and related intellectual property are owned by us or our licensors. These Terms grant a limited license and do not transfer ownership.
LastCUE may include open-source or other third-party components. Those components remain subject to their accompanying licenses and notices. If these Terms conflict with an applicable third-party license, that license controls for the relevant component.
rekordbox™ is a trademark or registered trademark of AlphaTheta Corporation. Pioneer DJ is a trademark of PIONEER CORPORATION. Other product and company names belong to their respective owners.
LastCUE is an independent product and is not affiliated with, sponsored, authorized, certified, or endorsed by AlphaTheta Corporation, PIONEER CORPORATION, Pioneer DJ, Apple, or any other relevant rights holder.
10. Disclaimers and No Guarantee of Results
To the extent permitted by law and without limiting mandatory consumer rights, the Service is provided “as is” and “as available.” A repair output may be incomplete, inaccurate, missing metadata, unplayable, or incompatible with particular software or hardware.
We do not guarantee that LastCUE will recover any particular data or achieve any recovery rate; preserve every Cue point, tag, waveform, or other item during conversion or repair; remain compatible with a particular third-party format, software, hardware, or service; or continue to offer every feature indefinitely.
You must keep the original data and an independent backup and verify every output before relying on it.
11. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, willful misconduct, death or personal injury caused by negligence, or liability under mandatory consumer-protection law.
For consumers, we remain responsible as required by applicable law for direct losses that are a foreseeable result of our breach of these Terms.
For business users, to the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, goodwill, opportunity, data, business continuity, performance readiness, event income, venue or customer claims, substitute equipment, substitute services, data reconstruction, or repeat work. Our total aggregate liability arising from the affected Service will not exceed the amount you actually paid for that Service during the 12 months before the event giving rise to the claim. For a one-time purchase, the cap will not exceed the amount paid for that purchase.
To the extent permitted by law, we are not responsible for loss primarily caused by failure to keep an independent backup, selecting the wrong destination, first testing on an only copy or performance drive, insufficient storage, device disconnection, power loss, hardware or file-system failure, third-party changes, unauthorized use, or failure to follow a clear safety warning.
Where a jurisdiction does not permit a particular exclusion or limitation, it applies only to the maximum extent permitted there.
12. Suspension, Termination, and Changes
We may restrict, suspend, or terminate access if you materially or repeatedly breach these Terms, engage in fraud or unlawful activity, create a security risk, infringe third-party rights, fail to pay amounts due, or if we are legally required to act. Where appropriate and legally permitted, we will give notice and a reasonable opportunity to remedy the issue.
You may stop using the Service and cancel a subscription at any time. After termination, the software license and online paid entitlements end. Outputs and reports that you lawfully downloaded to your own device normally remain under your control. Termination does not affect rights, payment obligations, refund claims, or liabilities that arose before termination.
We may update these Terms for legal, security, technical, product, or business reasons. We will give reasonable notice of a material change through the registered email address, website, or application and identify its effective date. Where law requires express consent, we will request it. A material change will not retroactively alter a completed transaction or a non-waivable statutory right.
Provisions that by their nature should continue after termination—including ownership, payment, disclaimers, liability limits, and dispute provisions—will continue to apply.
13. Governing Law and General Terms
These Terms are generally governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. Mandatory consumer protections and jurisdiction rights that cannot be excluded in your country or region of residence continue to apply.
Before starting formal proceedings, please contact us so that we can try to resolve the issue in good faith. If the dispute is not resolved, either party may bring a claim before a court that has jurisdiction under applicable law.
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of it.
These Terms, the LastCUE Privacy Policy, the LastCUE Refund Policy, the commitments shown on the applicable purchase page, and terms expressly incorporated at checkout form the agreement governing your use of LastCUE. The checkout provider’s terms separately govern your transaction with that provider.
These Terms may be translated for convenience. Unless applicable law requires otherwise, the English version controls if language versions conflict.
