LastCUE is operated by SHUAI JINGYAN, an independent developer based in China, under the “LastCUE Lab” brand. For the personal data described in this policy, SHUAI JINGYAN is the controller unless another service, such as Creem, explains that it acts as a separate controller for its own processing.
This policy explains how LastCUE handles personal data when you use the website, desktop application, account, purchases, Repair Credits, support, and related features (collectively, the “Service”).
Short Version
- LastCUE is local-first. In the default workflow, your USB library and audio files are processed on your device and are not uploaded to our servers.
- We collect the limited account, entitlement, device, security, and support information needed to operate the Service.
- Creem handles payment details as the seller or Merchant of Record where shown at checkout. We do not receive your complete card number.
- We do not sell personal data or use it for third-party targeted advertising.
- Optional diagnostics, analytics, or support uploads are handled only as described below and can be avoided where the feature is optional.
1. Data We Collect
Depending on how you use LastCUE, we may process:
- Account data: email address, account identifiers, and profile information you choose to provide.
- Purchase and entitlement data: product, order or transaction identifier, currency, country or region, payment status, subscription status, and Repair Credit balance received from Creem or another checkout provider. Payment-card details are handled by the payment provider, not LastCUE.
- License, device, and security data: license or activation identifiers, limited device identifiers or hashes, application version, operating-system information, IP address, sign-in records, and security events used to deliver access and prevent abuse.
- Diagnostics: error messages, crash details, application state, performance information, and related technical data. Diagnostic data may sometimes contain local file paths, library names, or playlist names.
- Support data: messages you send us and any logs, metadata packages, screenshots, or test files you choose to provide.
- Website data: IP address, browser and device information, pages viewed, referral information, and cookie or similar-technology data where used.
- Communications: service notices, support correspondence, refund discussions, and your email preferences.
We do not intentionally collect your complete music library or audio files through the default local workflow.
2. How We Use Data
We use personal data to:
- create and secure accounts;
- deliver subscriptions, licenses, and Repair Credits;
- operate, maintain, troubleshoot, and improve the Service;
- provide support and process refund or entitlement requests;
- prevent fraud, abuse, unauthorized access, and security incidents;
- send important service, account, billing, or policy notices;
- send optional product news or marketing only where permitted, with an unsubscribe option; and
- comply with legal obligations and resolve disputes.
Where the GDPR, UK GDPR, or similar law applies, our legal bases may include performance of a contract, our legitimate interests in operating and securing the Service, your consent where required, and compliance with legal obligations.
3. Local Files and Support Uploads
In the default local workflow, LastCUE reads and processes source media and creates backups, reports, or repair outputs on your device. Unless you deliberately use an upload, cloud, remote-support, or similar feature, LastCUE does not send the complete contents of your USB drive or your audio files to our servers.
If you choose to send a support file, it may contain track or playlist names, Cue information, local paths, device information, or other data. Send only what is necessary. Remove audio files, passwords, unnecessary personal data, and third-party confidential information whenever reasonably possible.
Issue reports may include a report.zip package,
diagnostic metadata, app version, operation name, error details, run
logs, account audit summary such as user ID or account hash, package
size and hash, and your optional written message or contact details. An
original export.pdb is attached only if you separately opt
in inside the application, and it may contain track names, playlist
names, Cue information, and local paths.
Support-report packages and metadata are stored in private support storage, currently including Aliyun OSS where configured. Upload and download links are intended to be short-lived, and access is limited to people or systems that need it for support, security, abuse prevention, or legal compliance.
We use submitted files only to provide support, diagnose the reported issue, maintain security, and improve reliability. We do not use your music files or library contents for advertising.
4. Cookies and Analytics
The website may use cookies or similar technologies that are necessary for sign-in, security, language preferences, and basic operation.
Optional analytics or diagnostics are configured as follows:
We do not currently use optional analytics, advertising cookies, or automatic crash reporting.
Where law requires consent for a non-essential cookie or optional telemetry, we will request it before use and provide a way to change your choice.
5. Payments and Creem
Where Creem is identified as the seller or Merchant of Record, Creem independently collects and uses billing, payment, tax, fraud-prevention, and transaction data under its own privacy notice. We receive only the transaction and entitlement information reasonably needed to deliver and support your purchase.
We do not store or receive your complete payment-card number.
6. Service Providers and Disclosures
We share personal data only when reasonably necessary with:
- Creem, for purchases, tax, billing, receipts, subscription management, fraud prevention, and refunds;
- Alibaba Cloud (Aliyun), for public website hosting/CDN, Function Compute account and support-report APIs, Tablestore/OTS account and entitlement records, OSS support-report upload storage, and SMTP email delivery where configured;
- professional advisers, regulators, courts, law enforcement, or other authorities where disclosure is required by law or reasonably necessary to protect rights, safety, and security; and
- a successor or purchaser in connection with a genuine business transfer, subject to appropriate confidentiality and notice where required.
Service providers may process data only for the relevant service and under their own legal obligations or contractual restrictions.
We do not sell personal data or disclose it for third-party cross-context behavioral advertising.
7. International Processing
We are based in China, and our service providers may process data in China, Hong Kong, the European Economic Area, the United Kingdom, the United States, or other locations where they operate.
Data-protection laws may differ between countries. Where applicable law requires a transfer safeguard, we use or require an appropriate mechanism for the relevant transfer, such as an adequacy decision, approved contractual terms, or another legally recognized safeguard.
8. Retention and Security
We retain personal data only for as long as reasonably necessary for the purposes described in this policy, including while your account is active and for a limited period afterward, or longer where required for security, fraud prevention, accounting, legal compliance, dispute resolution, or enforcement.
Support files, issue-report packages, and diagnostic metadata are normally retained for up to 90 days after submission, then deleted or de-identified where practicable. We may retain a report longer only when reasonably necessary for an active support case, security investigation, abuse prevention, accounting, legal compliance, dispute resolution, or enforcement.
We use reasonable technical and organizational measures such as encrypted transport, access controls, limited access, and data minimization. No method of transmission or storage can be guaranteed completely secure. You are responsible for protecting your account credentials and local backups.
9. Your Choices and Rights
Depending on where you live, you may have the right to request access to, correction of, deletion of, or a copy of your personal data; restrict or object to certain processing; withdraw consent; or complain to a data-protection authority.
You can unsubscribe from marketing messages using the link in the message. Service and billing messages may still be sent when necessary to operate your account or transaction.
To make a privacy request, email support@lastcuelab.com. We may ask for reasonable information to verify your identity and protect the account. We will respond within the period required by applicable law.
Because we do not sell personal data or use it for third-party targeted advertising, we do not currently offer a separate sale or targeted-advertising opt-out. If our practices change, we will update this policy and provide any legally required choice.
10. Children
The Service is not directed to children under 16. We do not knowingly collect personal data from a child under 16 without legally valid authorization. If you believe a child has provided personal data to us, contact support@lastcuelab.com so we can investigate and delete it where appropriate.
If applicable law in your country or region requires parent or guardian involvement for you to use online services or provide personal data, use the Service only with that involvement and permission.
11. Third-Party Links
The Service may link to third-party websites or services. Their own privacy notices and practices apply. We are not responsible for how an independent third party handles data after you choose to use its service.
12. Changes to This Policy
We may update this policy when our Service, providers, or legal obligations change. We will post the updated policy and change the date above. If a change materially affects how we use personal data, we will provide additional notice where required.
